Terms & Conditions

 

If erratic rock only intervenes in the services of other independent suppliers (e.g. only connection flights, rent-a-car services, excursions, hotel accommodations, etc.), erratic rock is only responsible for the mediation of these services, but not for the services themselves. In this case, the Terms & Conditions of that supplier are relevant. If erratic rock is the tour operator, the general Terms & Conditions stated herein take effect.

Responsibility

Trip participants are responsible for understanding the conditions implied in the trip itinerary and selecting a trip which is appropriate to their interests and abilities; for bringing appropriate clothing and equipment as advised in the equipment list; for following normal standards of personal hygiene in order to lessen risk of traveler's diseases; for following normal social behaviour patterns with fellow trip participants; for acting in an appropriate and respectful manner in accordance with the customs of areas visited; for practicing a harmonic interchange with nature; for completing the itinerary as scheduled (or as adjusted in the field as necessary).

erratic rock is not responsible for missed parts of the tour or connections, if participants are late or do not show up.

The participants are responsible for fulfilling passport, visa, customs, device, and health regulations. All disadvantages resulting from non-fulfillment of these regulations are the sole responsibility of the participant.

erratic rock shall not be held liable for (A) any damage to, or loss of, property, or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider, and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent, thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. The participant waives any claim against erratic rock for any such loss, damage, injury, or death.

erratic rock only has limited influence on services purchased from other providers. Last minute changes in flight plans must be expected regularly. They are the responsibility of the airlines and the national flight coordination authorities.

Terms & Conditions

 

1. Bases of Rates
All prices and fares are quoted in U.S. dollars. The rates are based on current tariffs and are subject to change due to unforeseen circumstances. While we will do everything possible to maintain the listed prices, if it is necessary to levy a surcharge we reserve the right to do so and notification will be given at the time of final invoicing.

2. Program includes:
All transfers & all transportation, all meals on the trail or in the field, park fee, permits, camping costs, lodging costs (if included), group equipment, all logistics, guide fees, catameran costs.

3. Program Cost Includes
Please refer to each trip itinerary for more information about what is included.
Air transportation and related fees (except as indicated in the itinerary); transfers from arrival airport to hotel or meeting point and from hotel/meeting point to departure airport (except as indicated in the itinerary); excess baggage charges; excursions noted as optional in the itinerary; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, communication charges, alcoholic beverages; and any other items not specifically noted as included, meals in towns or cities (unless otherwise noted in the itinerary), non scheduled itinerary changes - emergency or non-emergency, non arranged meal requests or porters.

4. Reservations, Cancellations, and Refunds
A pre-payment of 100% of the total cost is required at the time you book. If there is any balance due, this will be collected before the departure date. 

Reservation or payment of any erratic rock tour constitutes your acceptance to our Terms & Conditions.

For all tour cancellations there is a $200 USD fee. Charges for cancellations are as follows:

91 - 62 days prior to departure: 10% of the total tour cost;

61 - 32 days prior to departure: 20% of the total tour cost;
31 - 10 days prior to departure: 50% of the total tour cost;
10 or fewer days prior to departure: 100% of the total tour cost.

Refunds are issued up to 30 days of the cancellation date. This policy also applies to pre- and post-trip extensions.

Changes of departure dates or excursions are only possible by canceling the reserved services and a rebooking afterwards. If these changes are made more than 60 days prior to departure, a US$ 20 fine per person will be charged.

If the participant does not show up at the beginning of the tour, misses a connection or is held incapable to continue the tour because of incomplete travel documents, this counts as a cancellation.

erratic rock reserves the right to cancel any trip because of inadequate enrollment that makes the trip economically unfeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If erratic rock cancels a tour prior to departure, you will receive a full refund of monies paid to erratic rock. If we cancel the trip in progress, you will receive a pro-rated refund based on the number of days not completed on the excursion. We will not be responsible for any refund for nonrefundable airline tickets, or for any airline tickets purchased by the passenger directly from an airline or travel agent.

Leaving an excursion in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of an excursion, such as hotel nights, meals, city tours etc.

Trip cancellation insurance is strongly recommended and advised.

5. Itinerary Changes
The presented itineraries are subject to modification and change by erratic rock without penalty. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent. erratic rock tour guides reserve the right to provide travelers with an alternative activity in the program if conditions are not appropriate.

We also reserve the right to change the order of the days in any itinerary under the sole discretion of the tour guide and based on operational considerations. The tour guide can also modified, change or eliminate part of the itinerary based on safety/weather considerations.

erratic rock reserves the right to make any member of the tour responsible for unnecessary expenses or losses due to delays or irresponsible actions caused by the participant.

Travel agencies and intermediates are not authorized to change or accept and/or propose alterations of our programs and Terms & Conditions without our permission.

6. Health Requirements
You must be in a good physical and mental health. Any physical condition requiring special attention, diet, or treatment must be reported when the reservation is made. erratic rock reserves the right to decline to accept any person as a member of any of our tours. Our trip leaders have the right to disqualify anyone at any time during the trip, if they feel the trip member is physically incapable and/or if a trip member's continued participation will be detrimental to the health, safety, and general welfare of the individual involved or the group. Refunds are not given under such circumstances. Any possible additional expenses for return transfers are the sole responsibility of the trip member.

Because of the fact that hospital facilities for serious problems are often unavailable and evacuation can be prolonged, difficult and expensive, it is that we assume no liability regarding provision of medical care at any time during the trip.

All passengers over 50 years old who participate in any of our hiking or trekking programs and/or programs that include any other physical activity are requested to send ahead a doctor's certificate that states that they are able to safely accomplish the program they are interested in valid only with the signature and stamp of a physician.

erratic rock presumes that all participants know how to swim. Non-swimmers may only participate in any tour that includes any water activity with permission of erratic rock.

7. Baggage
For safety and because of space limits in vehicles, refugios etc. we recommend you to carry only the necessary equipment with you. You may leave all extra baggage and hard suitcases at our office or in the hotel until the end of the trip. All participant are responsible for carrying and taking care of his/her baggage at the airport, to/from the vehicles, inside the hotels, etc.

Baggage and personal effects are at owner's risk throughout the tour.

8. Provided Gear
Tents, stoves, trekking poles, etc. will be provided as mentioned in each itinerary. For lost and damaged gear caused by inappropriate use or treatment the participant will be responsible for the replacement cost.

9. Insurance
The client must accept full responsibility for insurance up to limits which the client may deem necessary. This insurance must cover personal accident, medical expenses, air ambulance, loss of effects, repatriation costs and all other expenses which may arise as a result of loss, damage, injury, delay or inconvenience occurring to the client. We highly recommend that all clients have personal travel insurance. When obtaining travel insurance, the client must ensure the insurer of the type of travel to be undertaken, specially when "adventure activities" are included in the trip and that it covers in South America.

Because of the insurance the participant is not unchained from his/her obligation to pay cancellation fees to erratic rock; he/she only has devolution rights against the insurance as mentioned in the conditions of the insurance.

10. Photography
erratic rock reserves the right to take photographs or videos during the operation of any tour or part thereof, and to use the resulting photography for promotional purposes, leaving the copyrights of this material to our company. By booking a reservation with erratic rock, tour members agree to allow their images to be used in such media; travelers who prefer that their image and/or voice not be used are asked to identify themselves to their expedition manager at the commencement of their trip.

11. Others
In many camping group tours it is necessary that the participants help preparing meals, setting up tents on their own, take care of and help with packing the equipment. It can also be necessary at night and during difficult weather conditions that tour members must participate actively in helping out and finding solutions for any possible problems.

Our guides are partly not allowed to operate as guides in Argentina. Within the restrictions of the Argentine law it is only allowed to bring a tour coordinator. The tour coordinator has limited possibilities and rights. The guidance etc. is reserved to local and licensed guides. We partly work with these local guides and under these circumstances it is possible that the guidance than is in Spanish.
